Terms of Service

These Terms of Service ("Terms") govern your use of the websites and mobile applications provided by Wild Honey on The Porch LLC ("Wild Honey on The Porch," "we," "us," or "our"), including Void Tarot and Simorgh (the "Services"). By downloading, installing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use our applications on devices you own or control, for your personal, non-commercial use. Where an application is distributed through the Apple App Store or Google Play, the applicable store's terms also apply, and this license is granted consistent with the usage rules of that store.

You may not:

• Reverse engineer, decompile, or disassemble the Services, except to the extent that applicable law expressly permits it;
• Rent, lease, sublicense, or resell the Services;
• Remove or obscure proprietary notices; or
• Use the Services to violate any law or the rights of others.

Where we release any portion of our software under an open-source license, that license governs those portions and takes precedence over this section for them.

2. Your Content

You retain all rights to the content you create in the Services — your readings, journal entries, notes, and profile information. We claim no ownership over it. Where content is stored locally on your device, you are responsible for maintaining backups.

If a Service allows you to publish content to other users, you grant us a limited license to host, store, and display that content solely for the purpose of operating that feature. You represent that you have the rights to the content you publish.

3. Acceptable Use

You agree not to use the Services to:

• Harass, threaten, defraud, or endanger any person;
• Post unlawful, infringing, or deliberately misleading content;
• Interfere with or disrupt the Services or their infrastructure; or
• Attempt to gain unauthorized access to any system or account.

Where the Services facilitate connections between people — as in Simorgh — you are solely responsible for your interactions with other users, including any arrangements you make offline. We do not vet users, verify their statements, or guarantee anyone's conduct. Exercise the same judgment you would in any arrangement with a stranger.

5. Purchases and Subscriptions

If an application offers paid features or subscriptions, purchases are processed by the platform's app store, not by us. Pricing, billing, renewal, and refund terms are governed by that store's policies. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period, and you can manage or cancel them in your app store account settings.

6. Availability and Changes

We may modify, suspend, or discontinue any part of the Services at any time. We may also release updates that change features. We are not liable to you for any modification, suspension, or discontinuation of the Services.

7. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT WILL BE ACCURATE.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILD HONEY ON THE PORCH LLC AND ITS MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS.

9. Indemnification

You agree to indemnify and hold harmless Wild Honey on The Porch LLC from any claims, damages, liabilities, and expenses arising from your misuse of the Services, your content, or your violation of these Terms or of any law or third-party right.

10. Termination

You may stop using the Services at any time by deleting the applications. We may suspend or terminate your access if you materially breach these Terms. Sections 2, 4, 7, 8, 9, and 11 survive termination.

11. Governing Law and Disputes

These Terms are governed by the laws of the United States and the State in which Wild Honey on The Porch LLC is organized, without regard to conflict of law rules. You and we agree to attempt in good faith to resolve any dispute informally by contacting us first. Nothing in these Terms limits any non-waivable rights you have under the mandatory consumer protection laws of your country of residence.

12. Apple-Specific Terms

For applications obtained through the Apple App Store: these Terms are between you and Wild Honey on The Porch LLC only, not with Apple. Apple has no obligation to furnish maintenance or support for the application. If the application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the application. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
